Consultation has concluded

Council decision/outcomes

During the consultation period a total of four (4) responses were received. Of these responses, one (1) person was in support of the proposal and three (3) people were opposed.

At its meeting on Tuesday 28 November 2023, Council considered the feedback received from the community and made the decision to seek approval from the Minister for Local Government to revoke (or change) the community land classification for the portion of the land at 962-974 Grand Junction Road, Holden Hill, with the intention to sell this land to Rafnix Pty Ltd (Supashock).

Council also resolved that:

  • A lease (for up to 18 months) be granted over the land to Rafnix Pty Ltd so that works associated with its expansion at 2-6 Ardtornish Street, Holden Hill may proceed
  • The Holden Hill Community Land Management Plan O-Bahn South be amended to include the lease to Rafnix Pty Ltd
  • That should the sale of portion of the Reserve proceed, the funds from the sale be allocated for upgrades and improvements to the public realm in the Holden Hill area.

Concerns raised about the proposal, particularly regarding the loss of green space and trees, effect on the buffer from Grand Junction Road, entry and exit to the site and potential traffic impacts were noted. Responses to these concerns are on page 180 in Attachment 2 of the Council report which is available on the website link below.

Council acknowledged the sentiment of the community feedback and after debating the issues raised, considered that, on balance, the benefits to the wider community warranted proceeding with the proposal by Rafnix Pty Pty Ltd.

The next steps are for Rafnix Pty Ltd to advise of its acceptance or otherwise of the purchase price of $205,000 as valued by Liquid Pacific Asset Consultants, following which Council will seek the Minister’s approval to revoke the community land classification.

Background

Council has received an unsolicited proposal from Rafnix Pty Ltd (trading as Supashock) to lease and subsequently purchase a portion of reserve land (see map and image to the right) along 962-974 Grand Junction Road in Holden Hill (approximately 412 square metres) which is part of O-Bahn Linear Park South.

The total Reserve area is 2,917 square metres and has extensive trees and vegetation, providing a visual screen and noise buffer along Grand Junction Road. The primary purpose of the land is a stormwater detention basin.

Council is proposing to grant a short-term lease to Supashock over 412 square metres of the Reserve. Subject to the outcomes of community engagement, a short-term lease over the subject land will allow Supashock to permit site works to commence as soon as possible while the land revocation proposal is being considered and, if approved, the land division (boundary adjustment) and land transfer process.

As O-Bahn Linear Park South is classified as Community Land, the Community Land Classification of the portion of Reserve needs to be revoked (changed) before any sale or purchase can occur. The revocation process requires that before making a decision, Council must consult with the community. If Council decides to proceed with this change, final approval from the State Government’s Minister for Local Government is required.

The Community Land Management Plan (CLMP) for Holden Hill (O-Bahn Linear Park South) would also need to be changed to allow the land to be leased in the short-term.
