Proposed sale of land on Valiant Road, Holden Hill for a car park

Council decision/outcomes

During the consultation period, a total of 62 responses were received. Of these responses 66% (41 people) were supportive of the proposal, 31% (19 people) were opposed and 3% (2 people) were neutral. Just over a half (36 people) indicated they worked in a business in the local area.

At its meeting on Tuesday 9 August 2022, Council considered the feedback received and made the decision to seek the consent from the Minister for Planning to change the Community Land classification for the reserve land at 13 and 21-27 Valiant Road Holden Hill, with the intention to sell this land to Rafnix Pty Ltd for the construction of a car park. This decision is on the condition that Rafnix Pty Ltd formally accepts the valuation for the land prepared by McGees Property Valuers and agrees in writing to the total purchase price of $1.37 million (plus GST).

Council acknowledged that there were local residents and business owners who raised concerns about this proposal, particularly around the loss of green space and potential impact on traffic in the area. Responses to these concerns are included in the Council report (see Attachment 4) and where applicable would be assessed as part of the Development Approval process with reference to the Planning and Design Code of SA.

Further decisions made by Council in relation to this matter, should the sale of the land proceed, include:

  • proceeds from the sale be used to fund dedicated projects within the suburb of Holden Hill
  • include a Deed with a caveat over the two subject land titles for Council to have first option to purchase the land back at an agreed value should the car park not be required and/or the Supashock expansion development does not proceed
  • amend the Tea Tree Gully Community Land Management Plan to include the short-term lease of the land to be used as a car park provided that Development Approval is granted for the expansion of Supashock at 2-6 Ardtornish Street, Holden Hill and the car park at 13 and 21-27 Valiant Road, Holden Hill.

Terms and conditions associated with the granting of a short-term lease include:

  • access to the land is not authorised until Development Approval is issued
  • the period of the lease is for a maximum of two (2) years to commence from the date of occupation or lease execution, whichever occurs first
  • a sunset clause to be included to provide Council with the right to terminate the lease if Development Approval has not been issued within 12 months from the date of the lease document
  • that the car park construction is in accordance with the concept plan displayed during the community engagement period and in accordance with Development Approval, whichever provides the most suitable tree-lined buffer between the western side of the car park and Valiant Road and includes water sensitive urban design
  • use of the car park is not permitted during the hours of 10pm and 7am on any day. This is to minimise noise and inconvenience to residents to the south west of the proposed parking site.

Background

Council has received a request from Rafnix Pty Ltd to purchase land from Council on Valiant Road in Holden Hill to develop a car park for their Supashock operations, and to facilitate the company’s expansion at their site at 2-6 Ardtornish Street, Holden Hill. Supashock is a designer and manufacturer of advanced suspension systems for road vehicles, ranging from racing cars through to defence equipment.

Supashock has advised Council that at least 100 parking spaces will be required for existing and additional staff associated with the proposed expansion, as the expansion will result in a shortfall of parking spaces at the Ardtornish Street site.

The reserve land on Valiant Road proposed for sale is 3,207m2 and is part of O-Bahn Linear Park South Reserve (see map). The land is undeveloped with natural grasses, one regulated tree and other small trees and shrubs, and is not used for active or passive recreation. See photos of the site

Supashock has developed an indicative concept plan for the proposed car park which would be fenced and gated.

The price paid for the portion of reserve land would be based on an independent commercial market evaluation. Proceeds from the sale of this land would be used for upgrades in the local area.

As O-Bahn Linear Park South Reserve is classified as Community Land, the Community Land Classification of this portion of the reserve needs to be changed (or ‘revoked’) before any sale can occur. The revocation process requires that before making a decision Council must consult with the community. If Council decides to proceed with this change, final approval from the State Government’s Minister for Planning is required. Development approval will also be required under the Planning, Development and Infrastructure Act 2016 in order for the Supashock expansion and the car park works to proceed.

Short term approval (lease or permit)

Should Council approve the sale of this reserve land, after considering the views of the community, Council may also look at issuing a short-term lease or permit (less than two years) to Supashock to allow site works to commence while the land transfer process is occurring through Land Services SA. Granting a short-term lease for the construction of a car park would mean changing the Community Land Management Plan that relates to this reserve, as this use is not currently envisaged in the plan.
