Draft Community Land Management Plans – Parks, Natural Areas & Tree Screens

The Local Government Act 1999 requires councils to identify land that is known as “community land” in their areas and to adopt management plans for these and make these publicly available.
This can include whether land is occupied under a lease or licence, or if the land has been specifically modified for the benefit or enjoyment of the community, eg playgrounds, seating, BBQs etc. Community Land Management Plans (CLMPs) stipulate when community engagement is required to amend a CLMP or undertake development that is not envisaged in the CLMP and to generally guide decisions about maintenance and upgrades.
The intent of the requirement for councils to prepare and adopt CLMPs is to preserve the interests of the community in the community land.
A comprehensive review of Council’s sixty-four CLMPs affecting 490 sites is currently underway.
At its meeting on 12 September 2023 Council adopted the CLMP framework for Sporting and Community facilities and following community engagement, the nineteen (19) new draft CLMPs for Sporting and Community facilities were adopted by Council at its meeting on 28 November 2023
The CLMP framework includes criteria from Council’s Open Space Policy to guide and identify groups of community land that aligns with the description for Sporting and Community, Parks, Natural Areas and Tree Screens which aligns with one of the objectives of the review which rationalises the number of CLMPS and reduces administrative burden.
This round of draft CLMPs focusses on Stage 2, Deakin Reserve (1x plan) due to its reclassification to Sporting and Community, and Stage 3 including Major Parks (9x plans), Minor Parks (1x plan), Natural Areas (1x plan) and Tree Screens (1x plan).
The Parks, Natural Areas and Tree Screens CLMPs include a provision for Council to negotiate and enter into easements with interested parties, including adjoining land owners. Easements may include but are not limited to rights of way, easements for light and air, service and maintenance easements in favour of utility providers, landscaping reserves, easements to allow encroaching structures that do not limit the objectives for the land.
The thirteen (13) draft CLMPs for parks, natural areas and tree screens are now available for comment:

- Bentley Reserve - Draft Community Land Management Plan
- Civic Park - Draft Community Land Management Plan
- Deakin Reserve - Draft Community Land Management Plan
- Jubilee Reserve - Draft Community Land Management Plan
- Minor Parks - Draft Community Land Management Plan
- Natural Areas - Draft Community Land Management Plan
- O-Bahn Linear Park - Draft Community Land Management Plan
- River Torrens Linear Park - Draft Community Land Management Plan
- Robertson Reserve - Draft Community Land Management Plan
- Tolley Reserve - Draft Community Land Management Plan
- Tree Screens - Draft Community Land Management Plan
- Whinnen Reserve - Draft Community Land Management Plan
All feedback received will be presented to Council for its consideration before these CLMPs are finalised. The final round of draft CLMPs for Cultural & Heritage areas requires further investigation and will be presented for community engagement in 2025.
